Very good question. IMHO, it is because crimes don't
exist where laws don't define them. Note the vague
language of "recklessly putting lives at risk".
History will (hopefully) look back at this time as a
period where law misunderstood how to deal with the
implications of information technology. Otherwise, if
we extrapolate the current trends of law concerning
IT, the future is very dark. In fact, I predict a new
Dark Age, where free speech is supressed. Hell, we're
on the cusp of it now.

Open information channels that can be encrypted using
cyphers the NSA can't break keep the Illuminati up at
night.
